Welcome to Webair AI. These Terms of Use (“Terms”) govern your access to and use of our website, platform, and AI-powered services provided by Webair AI LLC (“Webair AI,” “we,” “our,” or “us”). By using our services, you agree to these Terms. If you do not agree, please discontinue use immediately.
 
1. Use of Services

• Webair AI provides AI-powered business solutions, including chatbots, assistants, SEO tools, and the AirCore™ platform.

• You agree to use our services only for lawful purposes and in compliance with these Terms and all applicable laws.

• You are responsible for ensuring that your use of our services complies with HIPAA, GDPR, and other applicable regulations where required.
   

2. Account Registration

• Some services require an account. You must provide accurate, current, and complete information.

• You are responsible for maintaining the confidentiality of your login credentials.

• You agree to notify us immediately of any unauthorized access or security breach.
   

3. Privacy and Data Protection

• Our Privacy Policy explains how we collect, use, and safeguard your data.

• By using our services, you consent to our data practices as outlined in the Privacy Policy.
   

4. Intellectual Property

• All content, technology, trademarks, and materials on the Webair AI platform (including AirCore™) are owned or licensed by Webair AI.

• You may not copy, modify, distribute, or reverse-engineer any part of our services without written consent.
   

5. Prohibited Uses
You agree not to:

• Use our services for unlawful, harmful, or fraudulent purposes.

• Attempt to disrupt or compromise the security or integrity of our platform.

• Upload content that violates intellectual property, privacy rights, or applicable law.

• Use our AI systems in ways that promote misinformation, discrimination, or harm.
   

6. Compliance Responsibilities

• Certain industries (e.g., healthcare, finance, legal) require regulatory compliance (HIPAA, GDPR, SOC 2, etc.).

• Webair AI provides HIPAA and GDPR-ready infrastructure; however, you are ultimately responsible for ensuring compliance in your organization’s use of our services.
   

7. Third-Party Services
Our platform may integrate with third-party tools or APIs. We are not responsible for third-party services, and their use is governed by separate terms.

8. Disclaimers

• Webair AI services are provided “as is” and “as available.”

• We do not guarantee uninterrupted or error-free operation.

• To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.
   

9. Limitation of Liability

• Webair AI shall not be liable for indirect, incidental, or consequential damages arising from your use of our services.

• Our total liability to you shall not exceed the amount you paid to us in the past 12 months.
   

10. Indemnification
You agree to indemnify and hold Webair AI harmless from any claims, damages, or expenses resulting from your misuse of our services or violation of these Terms.

11. Termination

• We may suspend or terminate your access to our services at any time for violation of these Terms or misuse of the platform.

• Upon termination, your right to use our services immediately ceases.
   

12. Governing Law & Dispute Resolution

• These Terms are governed by the laws of the State of New York, United States, without regard to conflicts of law principles.

• Any disputes will be resolved exclusively in the state or federal courts located in Nassau County, New York.
   

13. Changes to Terms
We may update these Terms from time to time. Updates will be posted with a new “Effective Date.” Continued use of our services constitutes acceptance of the revised Terms.
